Terms of Use
Manaboost (hereinafter referred to as “A”) asks the user (hereinafter referred to as “B”) to confirm the following terms of use and to accept the contents before using the service. If B is a minor, it is necessary to obtain the consent of a legal representative such as a person with parental authority.
Article 1 (Scope of Application and Changes to the Terms of Use)
- The scope of application and the Terms of Use shall include the information provided on A’s website as well as the information sent by A to B via e-mail, etc
- A may revise, change, or add new provisions to the Terms and Conditions at its convenience without notice to B. B agrees in advance that any changes or amendments to the Terms and Conditions shall apply to B regardless of whether they are made before or after the amendments.
Article 2 (About the Service)
- Use of Free Trial Lesson
1) By registering for the free trial lesson, B will be able to use the lessons provided by A for 4 times free of charge.
2) There is no obligation or financial burden to B even if they register for the free trial lesson or take the 4 free lessons.
3) This agreement will be applied to the free trial lesson.
4) A will notify B of the receipt of their registration by e-mail. - Payment for Paid Plans
1) The enrollment fee is 10,000 JPY (tax included). The cost of teaching materials varies from 5,000 JPY to 10,000 JPY (tax included) per year depending on the individual.
2) B will be asked to pay the enrollment fee and the lesson fee in an e-mail. The fees shall be paid through PayPal. Please be sure to check that the amount is in “JPY”, enter the fee amount and send it to us. - Cancellation
No refunds will be made for any reason after payment has been made. - Interruption of the lesson
Regardless of whether it is before or after a lesson has started, the lesson may be cancelled if:
1) The teacher is not feeling well.
2) Communication failure of the computer occurs
3) Emergencies such as a fire or a power outage occurs
4) Sudden natural disasters (earthquake, typhoon, etc.) occur
If any of the cases were to occur, a replacement lesson will be given. - Late arrival to the lesson
If B is late to start the lesson due to B’s personal circumstances such as a late arrival, computer malfunction, etc., the teacher will wait 10 minutes from the start time of the lesson, but if more than 10 minutes have passed, it will be treated as an absence. - Injury during the lesson
In the unlikely event that an injury or an illness occurs during the lesson, responsibility will not be taken for any illness, aftereffects, or death, regardless of the cause.
Article 3 (Required Equipment, Software, and Technical Environment)
- Please prepare the following
1) An Internet-compatible device (computer, tablet, smartphone, etc.)
2) Install Skype and obtain a Skype Name
3) Internet connection
Article 4 (Personal Information)
Please register your name, e-mail address, and other personal information when you apply. Your personal information will be used to contact you with the necessary information in regards to your lessons, and will not be used in any other unauthorized way.
Article 5 (Notification of Changes)
Please contact us if there are any changes in your address, e-mail address, or telephone number. We are not responsible for any disadvantage or loss sustained from not being able to contact B.
Article 6 (Handling of Registered Information)
- Refusal or Cancellation of Registration
A reserves the right to refuse or cancel the registration of B in the event that they fall under any of the following circumstances. In addition, please note that the amount you have already paid may not be reimbursed.
1) If B does not exist
2) If the registered information of B is false
3) If the registration of B has been canceled by A in the past
4) If B has committed any of the prohibited acts described in Article 8
5) If there is a risk of interference with the smooth operation of this service
6) If the A judges that the use of the service by B is inappropriate for any reason other than the above - Withdrawal and Re-registration
1) If B wishes to withdraw, they shall contact us by the 15th of the month to cancel for the following month
2) To re-register, please complete the registration process again
Article 7 (Use of Skype)
Since this service is provided using Skype, B is requested to confirm in advance the following matters regarding the use of Skype.
- Use of Skype
B shall use the features of the Skype calling software in accordance with Skype’s terms and conditions and regulations. - Preparation of Skype
Before starting to use this service, B shall download the software for Skype calls, obtain a Skype name, and confirm its functions and operation methods prior to the start of lessons - Handling of problems associated with the use of Skype
In the event that the service cannot be used by B due to a malfunction, inadequate setting, or failure of the Skype calling software and the hardware necessary for its use, it is beyond the scope of response by A and shall be resolved by B with the Skype service. - Inquiries about Skype
With regards to inquiries about the services provided by Skype, B shall refer to the information about Skype on our website, and B shall resolve the issue with the Skype service. - Security when using Skype
When opening files or URLs sent from tutors via Skype chat, B shall do so at their own risk. It is B’s responsibility to take measures such as installing anti-virus software to prevent any damages caused by files or URLs sent from tutors via the Internet. A will not be responsible for any damages. - Disclosure of Skype Name
1) The Skype Name registered by B will be disclosed to the tutor for the purpose of providing lessons.
2) If B does not wish to disclose their private Skype Name, they shall take precautionary measures such as obtaining a different Skype Name in order to receive this service.
Article 8 (Prohibited Acts)
- Types of Prohibited Acts
When using this service, B shall not perform any of the following acts, or acts that may lead to such acts.1) Assigning, using, selling, or changing the name of B’s right to use this service to others.
2) Infringing the honor or faith of A or its service. Acts that cause damage or harm.
3) Illegal acts or acts that are offensive to public order and morals.
4) Drinking alcohol or smoking during lessons.
5) Impersonation, or acts by which a third party other than the lesson user takes the lesson.
6)Registering false information.
7)Interfering with the operation of this service.
8) Any act that aims to make a profit in relation to the service, or any activity to prepare for such an act.
9) Any act that causes a disadvantage or damage to other members, A or third parties.
10) Criminal acts or acts that lead to criminal acts.
11) Harassment to tutors, bad behavior, or interfering with the progress of lessons. Harassment will be determined at the discretion of A after verifying the facts.
12) Inquiring for information that is not generally disclosed by A, such as the employment conditions of tutors, the location of the customer support center, or the Internet connection or server.
13) Any attempt by B or its agent to contact the tutor personally, whether online or offline, including sending or receiving e-mail.
14) Soliciting tutors to work for a service or company that may be a competitor of A.
15) Using abusive language toward customer support staff or interfering with customer support operations.
16) Use of one account by multiple users.
17) Any other actions that A deems inappropriate. Response to Prohibited Acts
If B commits any of the acts specified in the preceding paragraph, A may cancel the registration of B and, if A suffers any damage, they may unavoidably seek compensation for the damage and other necessary measures.
Article 9 (Disclaimer)
- B agrees that A shall not be liable for any and all damages arising out of or in connection with the following
1) The use of or failure of the service.
2) Unauthorized access to or unauthorized alteration of B’s transmissions or data.
3) Any statement, transmission, or action by a third party during the Service.
4) The learning efficacy of this service.
5) Any damage caused by the information that A communicates during the lesson.
6) Interruption of the service due to reasons beyond the responsibility of A, such as domestic or international political situations, natural disasters, etc.
Article 10 (Means of Communication)
The primary means of communication from A to B regarding this service shall be notified by e-mail or posted on this website. B is responsible for receiving A’s correspondence and being up to date with the communication. B shall not claim any responsibility from A for any disadvantage to B arising from B’s failure to confirm the information.
- Damages caused by using the service
B agrees that A shall not be liable to compensate B for any damage caused by a computer virus infection, etc. when using the service and any damage caused by software or delivery files used for the service. - Problems with the Service
In the event that the service is unavailable due to a malfunction of the service provided by a provider, server, cloud service, or other service provider used by A, or due to an act of a third party, such as alteration of data due to unauthorized access, A shall not be held liable for compensation.
Article 11 (Copyrights and Proprietary Rights)
The copyright and ownership of all trademarks, logos, and descriptions related to this service belong to A. B shall not use them without permission from A.
Article 12 (Governing Law and Exclusive Jurisdiction)
This Agreement shall be governed by the laws of Japan. The court with jurisdiction over the location of the head office of A shall have exclusive jurisdiction in the first instance over all disputes related to the use of the service.
Article 13 (Amendment of the Agreement)
A may change these Terms of Use at any time.
